Welcome to HarvestGrainLab ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our luxury boat charter offerings and the website found at harvestgrainlab.site (the "Service") managed by HarvestGrainLab.
By reserving a charter or using our Service, you consent to comply with these Terms. Should you not agree with any section of these terms, you are prohibited from using the Service.
2. Service Overview
HarvestGrainLab offers premium boat chartering services, which include, but are not limited to:
- Daily boat rentals
- Sunset tours
- Corporate getaways
- Private gatherings
- Extended charters
All offerings are dependent on availability and mariner conditions. We hold the right to adapt or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
When reserving a charter, you must:
- Be at least 18 years in age
- Provide truthful and thorough details
- Submit the necessary advance payment as specified in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A charter is only secured after we receive the payment and send you a written confirmation. We have the full discretion to decline service to any individual.
3.3 Availability
All charters depend on the accessibility of vessels and favorable mariner conditions. We will strive to meet your desired dates and times.
4. Payment Terms
4.1 Pricing
All fees are presented in € and comprise of all relevant taxes unless indicated otherwise. Prices are prone to alterations without prior notice.
4.2 Payment Schedule
- Advance payment: 50% of the entire charter cost due at the time of reservation
- Remaining balance: Payable 48 hours before the charter leaves
- Incidental expenses (if applicable): Payable upon the charter's end
4.3 Payment Methods
We accept main credit cards, electronic fund transfers, and authorised cheques. Payments are processed using secured, encrypted techniques.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours prior to departure: A full refund minus transaction fees
- Between 24 to 72 hours prior to departure: A 50% refund
- Less than 24 hours prior to departure: No refund provided
5.2 Weather Cancellations
If we deem weather conditions as unsafe, we will propose to:
- Reschedule the charter to an alternative available date at no extra charge
- Issue a full refund if rescheduling is impractical
5.3 Mechanical Issues
If the assigned vessel experiences mechanical issues, we will attempt to arrange an appropriate substitute. Should no substitute be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to instructions given by the crew
- Don safety gear as necessary
- Inform of any health conditions that could impact their well-being
- Stay within designated areas on the vessel
6.2 Prohibited Items
The items below are forbidden onboard:
- Glassware
- Illegal substances
- Weapons
- Excessive beverages (beyond moderate consumption)
- Animals (unless pre-sanctioned)
6.3 Conduct
Guests must act in a considerate manner. We have the authority to end a charter prematurely without a refund if guest behaviour poses a threat to safety or interferes with others' experiences.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the charges paid for your charter. We are not responsible for:
- Injuries caused by guest's recklessness
- The loss or damage of personal belongings
- Secondary, ensuing, or penal damages
- Delays related to climate conditions or events outside our oversight
7.2 Insurance Coverage
Our company maintains complete nautical insurance coverage for our vessels and operations. Passengers must arrange their travel and personal insurance.
7.3 Assumption of Risk
By engaging in our chartering services, you recognize marine activities come with inherent hazards and you accept accountability for your personal security and safety.
8. Modifications and Itinerary Changes
We have the right to alter itineraries, pathways, or schedules in light of climate conditions, safety considerations, or operational needs. We will strive to offer services of comparable value.
9. Force Majeure
We bear no accountability for postponements, cancellations, or changes owing to events beyond our control, inclusive of but not limited to:
- Extreme weather events
- Natural catastrophes
- Governmental edicts
- Seaport lockdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is managed as per our Privacy Policy statement. By utilizing our services, you consent to the gathering and usage of your information as outlined in the Privacy Policy.
11. Intellectual Property
All materials on our web platform, including text, visuals, trademarks, and photos, are secured by copyright and trademark laws. Reproduction, distribution, or creation of imitative works without our express authorization is prohibited.
12. Governing Law
The laws of Italy are the judicial framework governing these Terms. Any legal disputes will be resolved in the courtrooms of Portofino, Italy.
13. Changes to Terms
We hold the right to amend these Terms when necessary. Amendments will be posted on our website along with the date they were revised. Ongoing engagement with our services implies acceptance of the updated terms.
